Mobile Message Service Terms and Conditions

The Ashy Ko© mobile message service (the “Service”) is operated by Ashy Ko. (“ Ashy Ko© ”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Ashy Ko© SMS/text messaging service, you agree to receive recurring SMS/text messages with service messages, including updates, alerts, and information (e.g. order updates, account alerts, etc.) and promotions, specials, and other marketing offers (e.g., cart reminders) from and on behalf of Ashy Ko via text messages through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialling system or other technology.

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Ashy Ko©. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Standard message and data rates may apply from your wireless provider. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt out of the Service at any time. Click the unsubscribe link in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. If you have subscribed to other Ashy Ko© mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt-out separately from those programs by following the instructions provided in their respective mobile terms. We may change any shortcode or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a shortcode or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Your Copyright

Generally under copyright laws, the owner of the copyright in images or photographs is the person who created the images or took the photographs. All material on this site, including, but not limited to images, logos and illustrations, is protected by copyrights, trademarks, and other intellectual property rights which are owned and controlled by Ashy Ko©. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service, or any contact on the website through which the service is provided, without written permission by us (including, but not limited the resell of cakes, cupcakes, cookies, cakesicles, cake pops, chocolate shards, florals, add-ons, balloons or toppers).

Delivery and Cancellations

We deliver to the majority of the Sydney Metropolitan Area (only).

Standard delivery takes place Monday to Saturday (and some special occasions on Sundays) generally between 9:00 am to 5 pm on the delivery day and time selected.

Ashy Ko© requests that the recipient be available to receive the delivery on the day of delivery. If no one is available to accept the delivery, the customer gives Ashy Ko the “authority to leave” which means the box will be delivered outside the residence and or workplace (only if it is safe to do so).
Ashy Ko does not take responsibility for orders left unattended and which become ‘melted’ or ‘compromised by insects’.
It is the customer’s responsibility to ensure that the cake is collected and consumed and/or refrigerated.
The customer is communicated to before and during the delivery process by Invoice, which states the delivery date and/or E-mail, SMS, DM's which state when the product has been picked and estimated ETA.
We deliver our orders ourselves unless you choose to pick them up.

Should the delivery address supplied by the customer be incorrect or insufficient details (including contact details) are provided, Ashy Ko© cannot accept any responsibility. The customer must supply accurate details at the time of order.

We accommodate minor changes to orders; however, we require 7 days from the delivery date make sure to contact us at info@Ashyko.com quoting your invoice number.

Payments, Reschedulings, Cancellations and refunds

- A deposit of 30% must be made to confirm an order (50% for orders under $200).
- Deposits are non-refundable.
- Full invoice must be paid 7 days Prior delivery/pick-up date.
- Rescheduling requests subject to availability and will accrue 20% fee.
- Cancellations or refunds for all our orders can only be granted for the non-depository amount paid and according to the following terms.
Requests should be made in writing by email at info@Ashyko.com quoting your reference/invoice number.
Requests should be made 7 days prior the delivery/pick-up date.
- No refund will be given for a change of mind or for a slight variant of the photo/description of the product on the website, which is subject to change at any time. We will endeavour to ensure it is as close as possible to the photo/description.
- Orders that are already prepared, dispatched or in transit cannot be cancelled or refunded.

Products

Product design (including decorative features such as chocolates, buttercream, roses etc), colours and flavours may vary from images supplied on our website at the discretion of Ashy Ko© (subject to availability). All substitutions are of similar quality and value.
We reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
All our products may contain or contain Milk, Dairy, Soy, Eggs, Nuts and Gluten.

We’re not a NUT-FREE business.
Nuts or traces of nuts can be found in most of our products.
